Finally, copyright wins on the web

In a case which will have ramifications for all those involved in making content available on line, the High Court has given guidance on what amounts to authorising copyright infringement.

Court considers meaning of "vodka"

In an extended form passing off case, the High Court has found that Intercontinental Brands' VODKAT alcoholic drink, which is not a vodka, is being passed off as vodka.

Lego bricks may not be registrable as trade marks

Advocate General Mengozzi suggests a three stage approach in determining the validity of three dimensional trade marks and, on the facts of this particular case, held that Lego failed to meet such criteria and was therefore not registrable.

Are ISPs obliged to filter traffic for infringements?

The Belgian court asks the ECJ to consider whether a requirement for ISPs to filter network traffic to prevent illegal file-sharing is lawful/consistent with European legislation.

ITV successfully opposes fictional beer brands

ITV successfully opposes the registration of the fictional brand, NEWTON & RIDLEY, as a trade mark for beer, ale and lager.

Customs update - new procedure

Further changes to Customs procedure in relation to seizure of counterfeit goods came into effect on 10 March 2010.

Acts of US parent amount to "authorising" copyright infringement by UK subsidiary

The High Court decides that a US parent company was liable for participating in and authorising the copyright infringement of its UK subsidiary under the Copyright, Designs and Patents Act 1988.

A new record? Intercontinental gets back 1000 domains in a day

A decision under the WIPO Uniform Dispute Resolution Policy (which deals with .com domain names) where multiple complainants were allowed to bring a complaint against a single respondent who had registered over 1000 domain names which comprised or included the names of the complainants' hotel brands.
