Data Protection - what is personal data?

The Information Commissioner's Office (ICO) has issued an updated guidance note on identifying what is "personal data" in relation to the Data Protection Act 1998. It aims to give clarity following the Court of Appeal's narrow interpretation of "personal data" in Durant v Financial Services Authority [2003]. The guidance is in the form of a flowchart with a series of numbered questions that will assist a data protection practitioner to identify "personal data". This guidance will be particularly useful if an employer is dealing with a Subject Access Request. Please click here to read a guidance note on this subject issued by the ICO.
