Do you have an EU trade mark or design application which was pending on 1 January 2021, or one which was filed before 1 January 2021 and has progressed to registration since then, or is about to? If so, this alert contains important information.

You can only clone your application and keep its filing/priority date by making a new UK application and paying the application fee by 30 September 2021. Any new UK application will then be examined as though it had been filed directly at the UK IP Office.

You should check whether you have any pending EU trade marks or designs which were filed before 1 January 2021, or EU trade marks or designs that have progressed to registration since then or will do so by 30 September 2021. If you do, consider whether you should make an equivalent UK application now to maintain the EU filing/priority date.
