The sad reality of bringing a sex discrimination claim against a City investment firm, is that more often than not, this will be a career limiting decision for most would-be claimants, which is something that must always be factored into the equation when litigation is being contemplated.

That is why an out-of-court settlement is often a more satisfactory outcome, even if the pay-off may be less than the employee considers to be just and equitable.

For those employees who are undeterred and pursue the litigation jackpot, they will need compelling evidence that they have suffered prejudice in the job market as a result of bringing proceedings, which is never that straight forward as there may be a wide variety of reasons why a new job is not forthcoming. It will not be enough for a claimant simply to state that stigma caused them not to be invited for an interview.
